    1. The scope of personal data processing
      We process our users' personal data only when it is necessary to provide a functional website and our content and services. The collection and use of personal data of our users takes place only periodically with the consent of the user. The exceptions are those in which prior consent cannot be obtained for legal or circumstantial reasons and the processing of data is permitted by law.

    2. Legal basis for the processing of personal data
      As long as we obtain the consent of the data subject to process his/her personal data, art. 6 clause 1 (a) of the EU General Data Protection Regulation (GDPR) provides the legal basis.
      By processing personal data necessary to perform the contract to which the data subject is a party, Art. 6 clause 1 (b) of the GDPR applies as a legal basis. This also applies to processing operations that are necessary to perform the service before the conclusion of the contract.
      To the extent that the processing of personal data is necessary to fulfill the legal obligation to which our company is subject, Article 6 clause 1 (c) of the GDPR applies as a legal basis.
      In the event that the material interests of the data subject or another natural person require the processing of personal data, Article 6 clause 1 (d) of the GDPR applies as a legal basis. If the processing is necessary to protect the legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not prevail over the first-mentioned interest, Article 6 clause 1 (f) of the GDPR applies as the legal basis for processing.

    3. Data deletion and storage time
      The personal data of the data subject will be deleted or blocked as soon as the purpose of storage ceases to apply. In addition, data may be stored if it has been provided by a European or national legislator in EU laws, regulations or other provisions to which the administrator is subject. Blocking or deleting data will be carried out even after the expiry of the storage period specified in the above-mentioned standards, unless the storage of data is necessary for the conclusion or performance of the contract.
       

  4. Providing a website and creating logs

    1. Description and scope of data processing
      Each time you visit our website, our system automatically collects data and information from the operating system of the computer that is obtaining the access.
      The following data is collected:
      (1) Information on the type of browser and the version used
      (2) User's operating system
      (3) The user's internet service provider
      (4) The user's IP address
      (5) Date and time of access
      (6) Websites from which the user's system reaches our website
      (7) Websites opened by the user system via our website

      The logs contain the IP address or other data that allows assignment to the user. This may be the case, for example, if the link to the page from which users access the page or the link to the page to which the user is switching contains personal data.

The data is also stored in our system's logs. Storage of this data along with other personal data of the user does not take place.

      The legal basis for the temporary storage of data and logs is Article 6 Clause 1 (f) GDPR.

    2. Purpose of data processing
      Temporary storage of the IP address by the system is necessary to enable the website to be accessed by your computer. For this purpose, the user's IP address remains stored for the duration of the session. The data is stored in logs to ensure the functionality of the site. The data is also used to optimize the website and ensure the security of our IT systems. In this context, no data evaluation is carried out for marketing purposes. These purposes also include our legitimate interest in processing data in accordance with Article 6 Clause 1 (f) GDPR.

       

      • Storage time
        The data will be deleted as soon as it is no longer needed to achieve the purpose for which it was collected. In the case of collecting data in order to provide a website, the data will be deleted after the end of the relevant session. If the data is stored in logs, it will be deleted after 90 days at the latest. Further storage is possible. In this case, the user's IP addresses will be removed or distorted so that the accessing client will no longer be assignable.

        Collecting data for the purpose of providing a website and storing data in logs is absolutely necessary for the operation of the website. Therefore, there is no possibility to object on the part of the user.

      Newsletters are sent after registration on the website.
      You can sign up for a free newsletter on our website. Data from the contact form are transferred to us after subscribing to the newsletter. The minimum requirement is the user's email address.
      However, you can provide additional personal data for personalization:

      • Subscription date and time. If you have agreed to receive our newsletter, we will inform you about current auctions / offers / news / special actions that correspond to your personal interests.

        Newsletter is sent due to the sale of goods / services.
        If you buy goods or services from our website and provide us your email address, we can then use it to send you the newsletter. In this case, only direct marketing of our similar products or services will be sent via the newsletter.
        No data is disclosed to third parties in connection with the processing of data for the purpose of sending newsletters. The data will only be used to send the newsletter.

      The purpose of collecting a user's email address is to send a newsletter. The collection of other personal data as part of the subscription process is intended to prevent the misuse of services or the email address used.

    3. Storage time
      The data will be deleted as soon as it is no longer needed to achieve the purpose for which it was collected. The user's email address will therefore be stored as long as the subscription to the newsletter is active.

    4. Objection and deletion options
      The newsletter subscription can be canceled by the user concerned at any time. A link to this can be found in every newsletter. This also allows you to withdraw your consent to the storage of personal data collected during the subscription process. The data is then only available as so-called metadata without direct personal reference for statistical purposes.

      The legal basis for data processing, if the user's consent has been obtained, is Article 6 Clause 1 (a) GDPR. If the registration concerns the performance of a contract to which the user is a party or the performance of pre-contractual measures, an additional legal basis for data processing is Article 6 Clause 1 (b) GDPR. The legal basis for storing pseudonymized data for statistical purposes is Article 5 Clause 1 (b) GDPR in connection with Article 89 Clause 1 GDPR.

If the email contact is aimed at concluding a contract, then an additional legal basis for processing is Article 6 Abs. 1 (b) GDPR. The legal basis for storing pseudonymized data for statistical purposes is Article 5 Clause 1 (b) GDPR in connection with Article  89 Clause 1 GDPR.

      Other personal data processed during the sending process is aimed at preventing the misuse of the contact form and ensuring the security of our IT systems.

      The processing of personal data from the contact form is only for establishing contact or request. In the case of e-mail contact, this also constitutes a necessary legitimate interest in data processing.

    4. Storage time
      Personal data is stored solely for the purpose of filling the vacant job you have applied for. We also reserve the right to store your data for inclusion in the “Talent Pool” for 730 days after the recruitment process. As part of the application process, the user's consent is obtained for a storage period that exceeds legal requirements.

    5. Objection and deletion options
      The user may at any time withdraw their consent to the processing of personal data. You can contact us at any time via auctions@merkandi.com, to determine if your data will be deleted. The data is then only available as so-called metadata without direct personal reference for statistical assessments.

  4. Newsletter tracking

    1. Description and scope of data processing
      The newsletters we send contain so-called tracking pixels. Pixel tracking is a miniature graphic embedded in emails sent in HTML format to enable log recording and analysis. The personal data collected in this way will not be passed on to third parties. During the registration process, your consent will be obtained through the so-called double-selection procedure. The reference is made to this Privacy Notice.

      The legal basis for data processing after signing up for a newsletter is, if the user obtains consent, Article 6 Clause 1 (a) GDPR.

    3. Purpose of data processing
      Newsletter tracking is used to statistically evaluate the success or failure of online marketing campaigns. Thanks to this, we can track if and when the e-mail message is opened and which links in it are clicked. This allows us to improve and optimise our newsletter.

    4. Storage time
      The data will be deleted as soon as it is no longer needed to achieve the purpose for which it was collected. Data obtained in this way will be deleted after 180 days at the latest.

    5. Objection and deletion options
      The consent of the user concerned may be withdrawn at any time by unsubscribing from the newsletter. To do this, click on the appropriate link in each newsletter.
       

  5. Transfer of personal data to third parties

    1. Service provider
      Personal data is provided to our service providers as part of the contract. They are transmitted in accordance with the following information.

    2. Transport service provider
      In order to process contract services, the following personal data, contact person, delivery address and mobile phone number will be sent to our transport service provider. This is done on the basis of a legal authorization in accordance with Article 6 Clause 1 (b) GDPR for the performance of the contract.

    3. Other relevant service provider
      Special order combinations may require the involvement of professional service providers. In order to process contract services, personal data such as contact persons, delivery address and mobile phone number may be transferred to other relevant service providers, if required, depending on the requirements of the contract. This is done on the basis of a legal authorization in accordance with Article 6 Clause 1 (b) GDPR for the performance of the contract.

    4. Payment services and payment procedures
      If a person chooses one of the payment options in our online store during the order process, personal data will be sent to our payment service provider in accordance with the following information.

    5. For payment processing, we use payment systems provided by Paypal, MultisafePay, PayU, iYzico and Fondy providers. If you choose payment by these methods, we send the data provided during the ordering process solely for the purpose of payment processing. The data will only be transmitted if it is actually necessary for the payment to be processed.       • Google Analytics
        This site uses Google Analytics, a service for analysing network by Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; „Google”). The application includes the "Universal Analytics" operating mode. This enables data, sessions and interactions between multiple devices to be assigned to a pseudonymous user identifier, thereby analysing user actions on different devices. Google Analytics uses "cookies", which are text files stored on your computer and help to  analyse the use of the website. As a rule, data generated by cookies regarding the use of this website will be transmitted to a Google server in the USA and stored there. However, if IP anonymization is enabled on this site, your IP address will first be shortened by Google in the Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. The IP address sent by your browser as part of Google Analytics is not synchronized with other Google data. Google will use this information on behalf of the operator of this website to evaluate website usage, compile reports on website activity and provide other services regarding website activity and internet usage for the website operator.       • Google AdWords and conversion tracking
        To draw attention to our current projects and development, planned activities and services, we place Google AdWords ads and use Google Conversion Tracking. These ads appear after searching on Google Network sites. We have the option of combining our ads with specific search terms. We also use AdWords remarketing lists for classified ads. This allows us to customize search ad campaigns for users who have previously visited our site. The services allow us to combine our ads with specific search terms or place ads for previous users in which, for example, the services viewed by users on our website are advertised.

        For interest-related offers, we need to analyse the user’s behavior online. Google uses cookies to perform this analysis. When you click an ad or visit our website, Google sets a cookie on your computer. This information is used to address the user specifically to a subsequent query. More information on the cookie technology used can also be found in Google's comments on website statistics and in data policy. Using this technology, Google and we, as clients, receive information that the user has clicked and has been redirected to our websites in order to contact us via the contact form. Similarly, Google and we, as clients, use Google forwarding numbers to receive information that a user has clicked a phone number from us on the Internet and contacted us by phone. The information obtained in this way is used only for statistical evaluation to optimize advertising. We do not receive any information that personally identifies visitors. The statistics provided by Google include the total number of users who clicked on one of our ads and, if applicable, were redirected to our website page with a conversion tag. Based on these statistics, we can trace search terms for which our ad was clicked particularly often, and ads leading to user contact via the contact form or by phone. With regard to telephone calls from potential clients, the statistics provided by Google include: the call’s start time, end time, status (missed or received), duration (seconds), caller's area code, telephone charges and type of call.

      • Facebook Pixel
        On our website we use the "Facebook pixel" of the Facebook social network, 1601 South California Avenue, Palo Alto, CA 94304, USA. Tracking pixels are integrated on our pages. When you visit our website via a plug-in, a direct connection is established between the browser and the Facebook server. Facebook receives from your browser information that our site has been visited from your mobile device. If you are a Facebook user, this allows Facebook to associate your visit to our pages with your user account. Please note that as the provider of this site, we have no knowledge of the content of the data sent to Facebook or how Facebook uses this data. We can only select Facebook user segments (such as age, interests) in which our ads should be displayed.
